In order to process orders through our webshop esqualo.nl privacy-sensitive data or personal data is processed. EsQualo Fashion B.V. considers it of great importance to handle personal data with care. Personal data is therefore always carefully processed and protected by us. Personal data 

When using the website www.esqualo.nl, www.esqualo.com or www.esqualo.com/de we obtain certain data. This may include personal data. Personal data is information that can be traced to you as an individual, such as your name, address, e-mail address or telephone number. But also your IP address, your customer number at EsQualo, your order history and surfing habits are personal data. 

 

Personal data is only used with your permission and only to send your order or to carry out the service you have requested. We obtain this information from you when you visit our website, when you fill in certain details, for example when creating an account or filling in a form. It is also possible that we receive your data via other parties or other persons (for example, via someone who buys a gift for you and has it delivered to your address). We will only receive your details from other parties if you have given us your permission to do so. 

  

What information do we collect? 

 

1. Processing your order 

We need your personal data to process your order. Otherwise we will not be able to keep you informed of the status of your order and deliver it to you. This includes, for example, gender, name, date of birth, phone number, email address, billing and delivery address and payment information. 

  

EsQualo does not register any special personal information, for example, on religion, health, sexual orientation, origin, political affiliation and the like. 

  

In certain sections of the website you can choose to register. Incidentally, it is not compulsory to create an account immediately. If you do not create an account, your customer data will not be stored in the customer database. The disadvantage of this is that you cannot log in to view the status and purchase history. You will also have to re-enter your data each time you place a new order. 

 

We do not pass on your personal data to third parties, unless this is legally required or necessary when sending an order. By law, we must retain the data relating to your purchases for 7 years.

 

2. Data in your account 

After registering on the webshop, you can log into your account via "Customer Login". In this account, we save your customer data, such as your name, addresses, telephone number, e-mail address, date of birth and customer number. You can also see your purchase history in your account. If you have added items to your Wishlist, we will also save them for you in your account. 

  

If you want to change your personal data, you can do it yourself in your account. If you want to remove your data permanently, you can contact our customer service. Your details will be removed from our system within 30 days. 

 

3. Data for user-friendliness of the webshop 

To make sure you can shop as conveniently as possible and the webshop functions as well as possible, we use a cookie from Google Analytics. This will only be placed after your consent. We have concluded a processing agreement with Google in order to make agreements about how to handle our data. Through Google Analytics we collect your IP address, information about your browser and information about the type of device you use (desktop, tablet or mobile) when you visit esqualo.nl. Furthermore, Google allows you to use the obtained analytics information for other Google services. 

When you use the search function on our website, your search terms combined with the technical characteristics may be stored. The data obtained will be stored indefinitely for the purpose of statistical analysis. 

Google Analytics is also used to analyse the effectiveness of certain online campaigns. We use the following advertising functions of Google, with the following purposes:

  

Remarketing 

We use remarketing (Google Analytics) because we want to get in touch with you again and make you suitable offers. These functions are only enabled once you have given your consent to the placing of the cookies.

- Remarketing targeting function Google Adwords. You can opt out of this if you do not want to. 

  

- Similar groups targeting function Google Adwords. This is a function to show ads to potential new visitors with similar characteristics and interests as the current users of our website. You can choose to opt out of Google cookie. 

- Bing Ads by Microsoft, Evert van de Beekstraat 354, Schiphol, Netherlands. Learn more about Bing Ads' Privacy and Data Protection Policy, the agreement, or more about their privacy policy. You can also unsubscribe from this.

- Double Click Platform integration with Google Analytics: We use this to gain more insight and to be able to offer advertisements in a more targeted way, for example via Google Adwords. 

 

- Display reports from Google Display Network: we use this to gain more insight into which users have seen our paid advertisements on other websites. This allows our ads to be more specific and relevant. 

- Integrated services for advertising purposes, for which Google Analytics collects data. Including data collected through ad cookies and IDs. 

  

Google Signals

Google Signals is used to collect additional data on the use of multiple devices. You can opt out of this via this link. In My Activity you can see which data is collected from you and delete it if necessary.

 

Customer match/audience 

We use customer match to increase our awareness. This means that we target e-mail addresses known to us. The email addresses are encrypted and only stored after permission has been given. We share these customized e-mail addresses encrypted with Google. Advertisements are shown on YouTube, Google search engine, Google Display network, Google Shopping, Gmail, Facebook and Instagram. Would you rather not be approached in this way? Then you can opt out. 

We also collect automated information on the use of our website via cookies. This enables us to compile statistics on the use of the website and to send more targeted communications. Facebook and Google Adwords also make this type of data available to us via Audience Insight. We do this to be able to form a better picture of the target group and the visitors, such as their interests, ages and locations. This allows us to improve the website based on the wishes and preferences of the users. This data is tracked via tracking cookies, to which you must give your prior consent. Demographic data 

We also collect demographic data. To do this, we use Google Analytics demographic and interest category reports. This allows us to learn more about website users, such as age, gender, interests, on an anonymous and aggregated level. We use this to customize the website for the best possible experience. This does not contain any personal information that identifies the user as an individual. 

 

Google may provide information to third parties if they are legally obliged to do so or if these third parties process the information on Google's behalf.

4. Contests 

If you take part in a promotion or competition, we will ask for your details, such as your name, address and/or e-mail address. We need this information to designate a winner and to send the prize. We will only collect this information with your permission. The terms and conditions of the relevant campaigns will explain what your details will be used for. 

  

5. Contact form 

There are various contact forms on the website whereby various details are requested that are necessary in order to deal with the question or the request. These data are kept for as long as is necessary according to the nature of the content of your e-mail to enable it to be fully answered or dealt with. 

  

6. Publication 

We do not publish customer data without permission. 

  

Advertising and advertisements 

In addition to the information available on the website, we inform you about new collections and promotions. 

  

E-mail marketing 

When you sign up for our newsletter, we ask you to fill in your details. These are details such as gender, name and e-mail address. You provide these details voluntarily. 

  

We use your e-mail address to inform you by e-mail about the development of the website and about our collections, brands and actions if you have given us permission to do so. If you no longer appreciate this, there is the possibility to unsubscribe directly via a link in our newsletter. 

 

By post 

A few times a year we also send information by post, such as information about new collections, promotions or about your saved points. If you do not wish to receive this information, please contact our customer service. They will then ensure that you no longer receive information by post. 

  

Social media 

Via Social Media, we would also like to keep you informed of new collections, styling tips and current actions. Do you no longer wish to follow this information? Then you can choose to stop following us. 

 

Advertisements

We do not display external advertisements on our website. 

  

EsQualo does not make information about visitors to its websites available to third parties and keeps all data strictly confidential and with the greatest care. 

  

7. Where do we store your data? 

We store your data within the European Economic Area ("EEA"). However, some of the data that we collect may be transferred to, or stored at, a destination outside the EEA. This is for example the case with external service providers which are based outside the EU, such as Google and DotDigital. We have good agreements with these parties and we make sure that this happens in a safe and lawful way.

 

Use of Hotjar 

In order to better understand the needs of our visitors and to improve our service and the corresponding experience, we use Hotjar. Hotjar is a technology service that allows us to analyse how much time visitors spend on which page, which links they click on and what users like or dislike. This helps us to improve the website with the help of user feedback. Hotjar uses cookies and other technologies to collect the data. Data such as device IP addresses (captured and stored in an anonymous form), screen resolution, device type, browser information, geographical locations (on a country level) and preferred language. This function is only enabled once you give your consent to the placing of cookies. Hotjar stores this information in a pseudo anonymised user profile. You always have the right to see, request and have removed the personal information we hold about you. To do so, please contact our customer service team. You can also opt out of the creation of a user profile, the storage of data on your use of our website by Hotjar and the use of tracking cookies by Hotjar on other websites: opt-out option. 

  

Providing to third parties 

We will not share your personal data with third parties, unless these are our partners who are involved in the execution of the service, such as sending an order. Think for example of a DHL that has to deliver your package. 

Our partners are (also) located outside the EU. We therefore ask your explicit permission before they receive data. 

  

Data outside the EU 

Outside the EU / EEA, data may only be transferred to countries with an 'appropriate security level' according to the Dutch Data Protection Authority. Dotdigital and Google are based in the UK and the USA. This is not designated as a country with an adequate level of security. Fortunately, both Dotdigital and Google are certified for the EU-US Privacy Shield. On that basis, we are permitted to share personal data with them. 

  

Cookies 

Our website uses cookies. Cookies are also placed by third parties who have been engaged by us. When you first visit our website, a notice will be displayed explaining why and why we use cookies. If you agree and/or make further use of our web shop, we will interpret this as consent to the use of cookies. 

  

You are free to disable cookies in your browser. However, please note that our website may not work optimally anymore. 

  

We have made clear agreements with third parties who use cookies about their use. We do not have full control over what the provider of these cookies does with the cookies, where they read them from. You can read more about the cookies in our cookie statement. 

 

Security 

We take security measures to limit abuse and unauthorised access to personal data. In particular, we take the following measures: 

 

- Access to personal data is protected with a user name and password 

- We make use of secure connections (SSL) with which all information between you and our website is protected when you enter your personal data. 

 

Storage period 

The personal data described above will be kept as long as necessary to process your order (including warranty), or for as long as necessary to complete your request. For order data, we have a tax retention obligation of 7 years for payment data. 

  

In addition, we use your statistical data for 50 months for the described statistical purposes. These data are then deleted, unless there is a legal obligation that requires longer retention. 

  

Websites of third parties 

This privacy statement does not apply to third-party websites that are connected to our webshop by means of links. We recommend that you read the privacy statement of these websites before using them. 

 

Inspection, amendment and deletion of your data 

If you have any questions about this privacy statement or any questions about/ requests for access to, alteration of or deletion of your personal data, you can always contact our customer service department. 

  

You can also submit a request to us to make a data export for data that we use with your permission. Or you can motivate us to restrict the processing of your personal data.

 

To prevent abuse, we may ask you to provide adequate identification. When it comes to access to personal data linked to a cookie, you must send a copy of the cookie in question. You can find this in the settings of your browser. If the information is not correct, you can request us to change or remove it. 

 

Personal data authority 

Of course we are happy to help you if you have any complaints about the processing of your personal data. Under the privacy legislation, you also have the right to lodge a complaint with the Personal Data Authority against the processing of personal data.
